Beauxmed Affiliate Programme Terms & Conditions
These Affiliate Programme Terms & Conditions (“Terms”) govern participation in the Beauxmed Affiliate Programme (“Programme”).
By applying for, accessing or participating in the Programme, you (“Affiliate”, “you” or “your”) agree to these Terms and any campaign-specific terms separately provided to you.
“Beauxmed”, “we”, “us” and “our” refer to the business operating the Beauxmed brand.
1. Eligibility and Application
Participation in the Programme is subject to application and approval by Beauxmed.
Applicants must:
- have legal capacity to enter into this agreement;
- provide accurate and complete application information;
- provide genuine social-media, website or promotional-channel information where requested; and
- comply with applicable laws, regulations, platform rules and advertising standards.
Submission of an application does not guarantee acceptance.
Beauxmed may approve, reject or request additional information regarding any application.
Approved Affiliates will receive access to the relevant affiliate tools, dashboard, referral links, promotional codes or campaign materials.
2. Nature of the Relationship
Participation in the Programme does not create an employment, agency, partnership, joint venture, franchise or representative relationship between the Affiliate and Beauxmed.
Affiliates operate independently and are responsible for their own business activities, content, expenses, taxes and legal obligations.
Affiliates have no authority to enter into agreements, make commitments or incur liabilities on behalf of Beauxmed.
3. Affiliate Commission Structure
Beauxmed may offer different commercial arrangements to different Affiliates.
Depending on the Affiliate or campaign, compensation may include:
- percentage-based commission;
- fixed commission;
- product-specific commission;
- campaign-specific commission;
- performance bonuses; or
- other incentives agreed separately.
The commission structure applicable to an Affiliate will be shown in the Affiliate Dashboard, communicated by Beauxmed, or stated in separate campaign terms.
Different Affiliates may receive different commission rates or reward structures.
Percentage-Based Commissions
Unless otherwise stated in writing, percentage commissions are calculated on the eligible product value after applicable discounts, excluding:
- shipping charges;
- applicable taxes;
- refunded amounts; and
- other non-product charges.
Fixed Commissions
Where a fixed commission applies, Beauxmed will specify whether the amount applies per eligible order, product, unit or other agreed conversion event.
Campaign-specific terms may override the standard Programme commission rules.
4. Eligible Referrals
A referral is generally eligible for commission when:
- the purchase is successfully attributed to the Affiliate;
- payment has been successfully received;
- the order is genuine;
- the order has not been cancelled, refunded, returned or charged back; and
- all Programme requirements have been satisfied.
A referral initially appearing in the Affiliate Dashboard as pending or unpaid does not constitute a final entitlement to payment.
Beauxmed may subsequently reject or adjust a referral if the related transaction becomes ineligible.
5. Ineligible Transactions
Commission will not be payable on transactions involving:
- cancelled orders;
- refunded or returned orders;
- chargebacks;
- failed or unpaid orders;
- fraudulent or suspicious transactions;
- self-referrals;
- artificially generated transactions;
- duplicate referrals;
- unauthorised coupon use;
- transactions created primarily to obtain commission; or
- violations of these Terms.
Beauxmed may investigate suspicious activity before approving payment.
6. Referral Tracking
Affiliate referrals may be tracked using technologies including:
- unique referral links;
- affiliate identifiers;
- cookies;
- promotional coupon codes; and
- other tracking mechanisms used by the Programme.
Where more than one Affiliate may potentially receive attribution for the same customer, Beauxmed’s tracking system and applicable attribution rules will determine which Affiliate receives credit.
Tracking can be affected by browser settings, cookie restrictions, device changes, privacy technology and other circumstances outside Beauxmed’s control. Therefore, Beauxmed cannot guarantee that every referral will be successfully tracked.
7. Affiliate Coupons and Promotional Codes
Affiliate coupons and promotional codes remain the property of Beauxmed.
Affiliates may only use codes:
- assigned or approved by Beauxmed;
- during their authorised campaign period; and
- in accordance with the stated promotion conditions.
Affiliates must not:
- modify coupon terms without permission;
- advertise expired offers;
- falsely represent a discount;
- distribute private or restricted codes;
- submit Beauxmed codes to coupon websites without permission; or
- create misleading variations of official coupon codes.
Beauxmed may change, suspend or withdraw promotional codes at any time where reasonably necessary.
8. Advertising Disclosure
This section is important for your TikTok, Instagram and Xiaohongshu affiliates.
Affiliates must clearly disclose when content forms part of a commercial relationship with Beauxmed.
Malaysia’s Content Code states that endorsements, reviews and testimonials provided under a commercial arrangement should be clearly identified as advertising. It recommends clear upfront terms such as “Advertisement”, “Ad” or “Sponsored”, says disclosure should be in the same language as the endorsement, requires video disclosures to appear within the video itself, and says livestream disclosures should be repeated periodically.
Accordingly, Affiliates must make disclosures clearly and prominently and must not hide them among hashtags or use vague terms that could mislead viewers.
Examples include:
Ad / Sponsored by Beauxmed
or an equivalent clear disclosure appropriate to the language of the content.
9. Product Claims and Responsible Promotion
Affiliates must only make product claims that are:
- accurate;
- supportable;
- consistent with Beauxmed’s approved product information; and
- appropriate for cosmetic products.
Affiliates must not independently claim that a Beauxmed cosmetic product:
- diagnoses, treats, prevents or cures a disease or medical condition;
- provides guaranteed results;
- produces medical or therapeutic effects unless lawfully authorised;
- is “clinically proven” unless Beauxmed has specifically provided substantiation supporting that claim; or
- possesses scientific evidence that has not actually been established.
Malaysia’s NPRA requires cosmetic advertising claims to be substantiated, and cosmetic claims should not cross into medicinal claims. NPRA also monitors misleading, exaggerated and medical claims in cosmetic advertising.
The Malaysian Content Code also states that scientific terminology, statistics and research must not be used in a misleading way or made to appear more scientifically valid than the evidence supports.
When uncertain, Affiliates should use product information supplied or approved by Beauxmed.
10. Authentic Reviews and Testimonials
Affiliates may share genuine personal experiences but must not:
- fabricate testimonials;
- create fake before-and-after results;
- manipulate images in a misleading way;
- claim results they did not experience;
- impersonate customers or professionals;
- purchase fake reviews or engagement; or
- misrepresent another person’s experience as their own.
Opinions should reflect the Affiliate’s genuine experience.
11. Beauxmed Brand and Intellectual Property
Beauxmed grants approved Affiliates a limited, non-exclusive, revocable permission to use authorised Beauxmed:
- trademarks;
- logos;
- product images;
- promotional materials; and
- campaign assets
solely for authorised promotion under the Programme.
Affiliates must not:
- alter the Beauxmed logo in a misleading manner;
- register domains or social-media usernames containing Beauxmed without permission;
- represent themselves as the official Beauxmed company;
- create counterfeit packaging or promotional assets;
- copy protected website content for unrelated commercial purposes; or
- grant others rights to Beauxmed intellectual property.
All Beauxmed intellectual property remains owned by its respective rights holder.
12. Paid Advertising and Brand Keywords
Unless Beauxmed provides written permission, Affiliates may not purchase paid search or advertising placements using:
- “Beauxmed”;
- common misspellings of Beauxmed;
- Beauxmed product names; or
- other protected Beauxmed brand terms
as keywords intended to impersonate or compete with Beauxmed’s official advertisements.
Affiliates must not create advertisements that appear to be official Beauxmed advertisements unless specifically authorised.
13. Spam and Unsolicited Promotion
Affiliates must not promote Beauxmed using:
- unsolicited bulk messaging;
- misleading WhatsApp broadcasts;
- spam email;
- automated comments;
- deceptive direct messages; or
- other unlawful or abusive promotional practices.
Promotional activity must comply with applicable laws and platform rules.
14. Affiliate Content
Unless otherwise agreed, Affiliates remain responsible for the content they independently create.
By voluntarily providing promotional content to Beauxmed for reposting or campaign use, the Affiliate grants Beauxmed permission to repost or display that content for the agreed campaign or promotional purpose, subject to any separate creator agreement.
For major paid creator campaigns where you want broader advertising rights, whitelisting rights or indefinite content usage, use a separate creator/content agreement instead of relying only on these general Affiliate Terms.
15. Privacy and Personal Data
Beauxmed may process information required to administer the Programme, including:
- name;
- contact information;
- affiliate-account information;
- payment information;
- referral information;
- commission records; and
- other information supplied through the Programme.
Processing of personal data will be subject to the Beauxmed Privacy Policy and applicable Malaysian personal-data requirements.
Malaysia’s Personal Data Protection Act regulates personal-data processing in commercial transactions, and the 2024 amendments have commenced according to dates appointed by the Malaysian authorities.
Do not put affiliate bank-account details publicly on the website.
16. Payouts
Commission becomes payable only after Beauxmed has confirmed the underlying referral as eligible.
Before publishing this clause, choose your actual rules:
Payout Frequency: MONTHLY (wait until return/refund period has passed)
Minimum Payout: RM100
Payout Method: BANK TRANSFER
If an Affiliate does not meet the minimum payout threshold, eligible unpaid commission may be carried forward to the next payment period.
Affiliates are responsible for providing accurate payment information.
Beauxmed is not responsible for delays caused by incorrect or incomplete payment information supplied by the Affiliate.
17. Taxes
Affiliates are responsible for determining and fulfilling their own tax, reporting and regulatory obligations arising from commissions or other compensation received through the Programme.
Beauxmed may request information or documentation reasonably required for payment or compliance purposes.
18. Suspension and Termination
Beauxmed may suspend or terminate an Affiliate account where the Affiliate:
- breaches these Terms;
- makes misleading or prohibited product claims;
- engages in fraud;
- abuses coupons or referral tracking;
- damages or impersonates the Beauxmed brand;
- engages in unlawful or unethical promotional activity; or
- otherwise creates a material risk to Beauxmed or its customers.
Beauxmed may also discontinue the Programme or a campaign by providing reasonable notice where practical.
Termination does not create entitlement to commission from transactions that are fraudulent, invalid or otherwise ineligible.
Eligible commissions properly earned before termination may remain payable subject to these Terms.
19. Changes to the Programme
Beauxmed may update:
- Programme rules;
- commissions;
- campaigns;
- attribution rules;
- promotional codes;
- eligibility requirements; or
- these Terms
from time to time.
Material changes should be communicated through the Affiliate Dashboard, email or another reasonable method.
Continued participation following the effective date of updated Terms constitutes acceptance of the revised Programme terms, subject to applicable law.
20. Limitation of Liability
To the extent permitted by applicable law, Beauxmed will not be responsible for indirect or consequential losses arising from participation in the Programme, including losses caused by:
- tracking failures;
- platform outages;
- account suspension by third-party platforms;
- deleted social-media content;
- changes to third-party algorithms; or
- lost promotional opportunities.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
21. Affiliate Responsibility
The Affiliate is responsible for their own content, representations and conduct.
The Affiliate may be responsible for losses, claims or expenses arising from their breach of these Terms, infringement of third-party rights, unlawful advertising, or unauthorised claims about Beauxmed products, subject to applicable law.
22. Governing Law
These Terms are governed by the laws of Malaysia.
Any dispute arising from the Programme will be subject to the jurisdiction of the Malaysian courts unless the parties agree to another lawful method of dispute resolution.

24. Acceptance
By submitting an application, activating an Affiliate account or continuing to participate in the Programme, the Affiliate confirms that they have read, understood and agreed to these Terms.
